These Terms & Conditions (“Terms”) govern access to and use of the TrustRep.co website, platform, and related services (“Service”) operated by TrustRep (“we,” “us,” “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Definitions

User / You: Any person or entity that accesses or uses the Service.

Account: The user profile registered on the Service.

Content: All text, data, graphics, media, and other materials uploaded, posted, or transmitted by users.

Third-Party Services: Any external services, websites, or integrations accessible through TrustRep.co.

Fees: Charges applicable to premium features or paid plans.


2. Eligibility and Account Registration

You must be at least 18 years old or the legal age of majority in your jurisdiction.

You agree to provide accurate, current, and complete information during registration and to maintain it.

You are responsible for safeguarding your login credentials.

Notify us immediately of any unauthorized use of your account.

We may refuse registration or terminate accounts at our discretion.


3. Acceptable Use

You agree not to:

Violate any local, state, national, or international law.

Upload or distribute content that is defamatory, fraudulent, infringing, obscene, or otherwise unlawful.

Introduce malware or attempt to disrupt the Service.

Access or use the Service for competitive analysis, data scraping, or resale.

Misrepresent your identity or affiliation.

We may suspend or terminate accounts violating these provisions.


4. Content Rights and License

You retain ownership of your Content.

By posting Content, you grant TrustRep a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, host, reproduce, distribute, and display such Content as needed to operate and improve the Service.

You confirm you have all rights necessary to grant this license and that your Content does not infringe any third-party rights.


5. Payments and Fees

Some features may require payment.

Fees are stated at checkout and are non-refundable unless required by law.

We may change fees at any time with notice.

You authorize TrustRep and its payment processors to charge your selected payment method for applicable fees and taxes.


6. Suspension and Termination

We may suspend or terminate access at any time for:

Violation of these Terms;

Fraud or illegal activity;

Operational or security reasons.

Upon termination, your access ceases, and we may delete your data as permitted by law. Clauses on intellectual property, liability, indemnification, and dispute resolution survive termination.


7. Disclaimers

The Service is provided “as is” and “as available.”

We disclaim all warranties, express or implied, including merchantability, fitness for a purpose, accuracy, and non-infringement.

We do not warrant uninterrupted, error-free, or secure operation.

TrustRep is not liable for decisions made based on information from the Service.


8. Limitation of Liability

To the maximum extent permitted by law:

TrustRep shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Our total liability in any 12-month period will not exceed the greater of (a) USD 100, or (b) the amount you paid to TrustRep in that period.

These limitations apply under Wyoming and Colombian law except where prohibited.


9. Indemnification

You agree to indemnify and hold harmless TrustRep, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

your Content or use of the Service;

your breach of these Terms;

any violation of applicable law or third-party rights.


10. Third-Party Links and Services

The Service may include links or integrations with third-party products or sites. TrustRep is not responsible for third-party content, services, or policies. Use them at your own risk.


11. Changes to Terms

We may modify these Terms by posting the updated version with a new “Last Updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.


12. Governing Law and Dispute Resolution

For users located in the United States, these Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

For users located in Colombia, Colombian law applies, particularly Law 1581 of 2012 (Data Protection) and Law 1480 of 2011 (Consumer Protection).

Disputes must first be resolved through negotiation or mediation.

If unresolved:
  • Wyoming users submit to binding arbitration in Cheyenne, Wyoming, USA.
  • Colombian users submit to arbitration in Bogotá D.C., Colombia, administered under local arbitration rules.

Each party waives class or collective action rights to the extent permitted by law.


13. Severability and Waiver

If any provision is held invalid, the remainder remains enforceable. Failure to enforce a right does not constitute waiver.
